Terms and Conditions

These terms govern the use of aionvisualsluxury.com and set out the general framework of the services provided by Edoardo Falcone (“AION Visuals”). They are also provided in compliance with Italian Legislative Decree 70/2003. The commercial and operational terms of each engagement are set out in the specific quote/contract, which prevails in the event of conflict. The Italian version prevails.
1. Service provider
Edoardo Falcone (brand “AION Visuals”), VAT 04541470987, registered at [REGISTERED ADDRESS TO ADD], email info@aionvisualsluxury.com, certified email (PEC) [TO ADD]. Activity: production of video, Matterport virtual tours and photography for real estate.
2. Subject and scope
These terms govern: (a) access to and use of the site; (b) the general rules of the services. The service relationship with each client is governed by the accepted quote and/or the signed Collaboration Terms, which prevail over these general terms in the event of discrepancy.
3. Use of the site
The site content is provided for information and promotional purposes and does not constitute an offer to the public under Art. 1336 of the Italian Civil Code, but rather an invitation to treat. The controller may change content and service availability at any time without notice.
4. Intellectual property
The site and its content (text, the AION Visuals name and logo, video, photographs, graphics) are protected and owned by Edoardo Falcone or the respective rights holders. Reproduction, distribution or use, even partial, without written authorisation is prohibited.
5. Formation of the contract
Submitting the contact form is a request for information and not a binding order. The contract is formed only upon written acceptance of the quote by the client and confirmation by the controller.
6. Fees, payments and timing
Fees, payment terms and production/delivery times are set out in the quote. Unless otherwise agreed in writing, a deposit may be required on confirmation of the engagement. Filming and delivery are subject to the client’s full cooperation (site access, property availability, necessary information and authorisations).
7. Client’s obligations and warranties
The client warrants: that it is entitled or authorised to have the property filmed and published; that it has obtained releases from any persons filmed; the truthfulness and lawfulness of the data and content provided; compliance with applicable rules (planning, land registry, condominium, privacy). These matters remain the client’s exclusive responsibility.
The client indemnifies and holds Edoardo Falcone harmless from any third-party claim arising from breach of the above warranties or from the client’s use of the materials.
8. Consumer right of withdrawal
If the client is a consumer under Italian Legislative Decree 206/2005 (Consumer Code) and the contract is concluded at a distance or off-premises, the client has the right to withdraw within 14 days under Art. 52 ff.
As the services are made to measure or clearly personalised, the right of withdrawal is excluded under Art. 59(1)(c). Furthermore, where the client expressly requests that performance begin before the 14-day period expires, the client acknowledges losing the right of withdrawal once the service is fully performed (Art. 59(1)(a)), and in any case must pay for the work already carried out.
9. Copyright and licence of the materials
The materials produced (video, virtual tours, photographs) are works protected by Italian Law 633/1941. Unless otherwise agreed in writing, copyright remains with Edoardo Falcone, who grants the client a licence to use them for the agreed purposes (promotion and marketing of the specific property). Any other use, transfer to third parties or modification of the materials requires written authorisation.
The materials are delivered after payment in full of the agreed fee.
10. Use of materials for portfolio purposes
Unless otherwise requested in writing by the client, Edoardo Falcone reserves the right to use the materials produced — and to reference the property and/or the client — in its own portfolio, showreel, website, social channels and promotional materials. The client may object to such use by giving written notice to info@aionvisualsluxury.com before or upon delivery.
Where the materials depict third parties or their property, the client warrants that it has obtained the necessary releases and authorisations.
11. Limitation of liability
Edoardo Falcone is liable solely for the proper, workmanlike performance of the production of the commissioned audiovisual and photographic content.
To the extent permitted by law and save for cases of wilful misconduct or gross negligence (Art. 1229 Italian Civil Code), all liability is excluded for: the outcome and timing of the sale or rental of the property; the use of the materials by the client or third parties; the compliance of the property and the truthfulness of the information provided by the client; indirect or consequential damages; malfunctions, interruptions or temporary unavailability of the site; force majeure events.
For slight negligence only, any liability to compensate is in any case limited to the amount of the fee agreed for the engagement from which the damage arose.
12. Drone filming (UAS)
Aerial drone filming is carried out in compliance with Implementing Regulation (EU) 2019/947 and the applicable ENAC rules, subject to obtaining any necessary authorisations. The client cooperates to ensure site access and safety conditions. Performance may be suspended or postponed for weather, safety or no-fly reasons, without liability for the controller.
13. Processing of personal data
The processing of personal data is governed by the Privacy Policy, which forms an integral part of these terms.
14. Force majeure
The controller is not liable for any failure or delay in performance due to causes beyond its control, such as natural events, adverse weather, measures by authorities, technical failures or other force majeure events.
15. Changes to the terms
The controller may amend these terms. The terms in force at the date the enquiry is sent or the contract is concluded apply. The updated version is published on this page.
16. Governing law and jurisdiction
These terms are governed by Italian law. For relationships with professional (non-consumer) clients, the Court of Brescia has exclusive jurisdiction. For relationships with consumers, the mandatory jurisdiction of the consumer’s place of residence or domicile applies.
Under Art. 1341 and 1342 of the Italian Civil Code, the professional client specifically approves clauses 7 (obligations and indemnity), 9 (copyright and licence), 10 (portfolio), 11 (limitation of liability) and 16 (jurisdiction).
The Italian-language version of these terms prevails in the event of any discrepancy with translations. This text is informational and does not replace tailored legal advice.
